Terms of Service

These Terms of Service ("Terms") govern your use of the Pulsly website at pulsly.co, the Pulsly app at app.pulsly.co and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a business, you agree to them on its behalf and confirm that you are authorised to do so.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

The Service is provided by Pine Dev (CVR 43549723), Brendstrupvej 13, 1. th, 8200 Aarhus N, Denmark ("Pulsly", "we", "us"). You can reach us at hello@pulsly.co.

You must be at least 18 years old, or the age of majority where you live, to use the Service. You sign in with Google or with a link sent to your email address. Keep access to that email account and your Google account secure: you are responsible for everything that happens through your Pulsly account.

Give us accurate information and tell us at hello@pulsly.co if you believe your account has been accessed without your permission.

Pulsly lets you upload videos, images and text once and publish them to the social media accounts you connect, either immediately or at a time you choose. It also shows follower statistics for your accounts and public statistics for accounts you choose to follow as competitors.

We may improve, change or remove features. If a change materially reduces what a paid plan includes, we will tell you in advance and you may cancel.

When you connect TikTok, Instagram, Facebook or YouTube, you authorise Pulsly to act on your behalf within the permissions you grant, for example to publish the content you schedule and to read basic profile statistics. You can revoke this at any time by disconnecting the account in Pulsly or in the platform's own settings.

You must comply with the terms, community guidelines and policies of each platform you publish to, including the TikTok Terms of Service, the YouTube Terms of Service and the Meta Terms of Service. Pulsly is not affiliated with, endorsed by or sponsored by these platforms.

The platforms decide whether and when content appears. They may reject, delay, limit or remove posts, or change their services, and Pulsly is not responsible for their decisions. When publishing fails, Pulsly retries where it makes sense and notifies you.

You keep all rights to the videos, images, text and other material you upload ("Your Content"). You give Pulsly a worldwide, non-exclusive, royalty-free licence to store, process, copy, adapt (for example convert an image to a supported format) and transmit Your Content, only as needed to provide the Service to you, including sending it to the platforms you choose. This licence ends when Your Content is deleted from Pulsly.

You are responsible for Your Content. You confirm that you own it or have all rights, licences and permissions needed to publish it, including rights to any music, people or brands shown, and that it complies with the law and with the rules of the platforms you publish to. Where a platform requires you to disclose paid partnerships or promotional content, you must do so.

You must not use the Service to:

• publish content that is illegal, infringes others' rights, or is hateful, harassing, sexually explicit involving minors, or otherwise harmful;
• send spam or run fake, misleading or impersonating accounts;
• violate the terms or policies of a connected platform, or help others do so;
• access the Service by automated means, scrape it, or try to bypass plan limits or security;
• upload malware or interfere with the Service, our infrastructure or other users;
• resell or provide the Service to third parties without our written permission.

We may remove content or suspend accounts that break these rules.

Pulsly has a free plan with usage limits and a paid Pro plan. Current prices and limits are shown on our pricing page. Prices are in US dollars; applicable taxes are added at checkout.

Payments are processed by Stripe. Pro is billed monthly in advance and renews automatically until you cancel. You can cancel at any time in Settings → Manage billing; you keep Pro until the end of the period you have paid for, after which your account moves to the free plan. We will give you at least 30 days' notice of a price change, which applies from your next billing period.

If you are a consumer in the EU, you have a 14-day right to withdraw from a purchase. Because Pro is available immediately, you ask us to start the service right away when you subscribe. If you withdraw within 14 days, contact us at hello@pulsly.co and we will refund your first payment in full.

If a payment fails, we may move your account to the free plan until the payment is made.

We work to keep the Service available and to publish posts on time, but we do not guarantee uninterrupted or error-free operation, for example during maintenance or when a platform is unavailable. Support is provided by email at hello@pulsly.co.

You can delete your account at any time in Settings. This cancels any subscription and permanently deletes your posts, media, connected accounts and statistics, as described in our Privacy Policy.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law or by a platform, or if needed to protect the Service or other users. Where reasonable we will warn you first and give you a chance to fix the problem. If we close a paid account without cause, we will refund the unused part of the current period.

The Service, including its software, design, logo and name, belongs to Pulsly and is protected by intellectual property laws. These Terms give you a limited, personal, non-transferable right to use the Service while your account is active. If you send us feedback or ideas, we may use them without obligation to you.

Apart from the commitments in these Terms, the Service is provided "as is" and "as available". To the extent the law allows, we do not give any other warranties, for example that the Service will meet a particular need or that posts will reach a particular audience or result.

To the extent the law allows, Pulsly is not liable for indirect or consequential loss, such as lost profits, revenue, followers, data or business opportunities, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or USD 100 if that is more.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited by law, and nothing affects the mandatory rights you have as a consumer.

If you use the Service for business purposes, you will compensate Pulsly for claims by third parties, and related reasonable costs, that arise from Your Content or from your breach of these Terms or of a platform's terms.

We may update these Terms, for example when the Service or the law changes. For material changes we will notify you by email or in the app at least 30 days before they take effect. If you do not agree, you can cancel before then; continuing to use the Service after the changes take effect means you accept them.

These Terms are governed by the laws of Denmark. Disputes are decided by the Danish courts. If you are a consumer living in the EU, you also keep the protection of the mandatory consumer laws of your country and may bring a claim in its courts. We encourage you to contact us first so we can try to resolve the issue.
